The Supreme Court of Kazakhstan reports on the practice of collecting millions of tenge from droppers, the so-called accomplices of fraudsters, through whose accounts and cards the attackers distill illegally obtained money.
According to the Telegram channel of the Supreme Court, if the scammers could not be identified, the victims ask to recover money from the droppers, and the courts, as practice shows, take their side.
For example, the Karabalyk District Court of Kostanay Region considered two lawsuits for the recovery of unjustified enrichment against two 19-year-old students who decided to “earn extra money” as droppers. The plaintiff requested to recover more than 9 million tenge from each of them.
“One of the defendants denied unjustified enrichment, as he transferred the money received to the accounts indicated by the fraudster. The second noted that he did not know about banking operations on his accounts, did not transfer the money received to others, and did not open a bank account. Meanwhile, it turned out that the bank’s mobile application was registered by its biometric verification with the entry of security codes sent to its number,” the Telegram channel of the Supreme Court reported.
The plaintiff did not know the students, did not enter into transactions with them, had no obligations to them, and was not involved in charity. The court concluded that there was unjustified enrichment at the expense of the plaintiff in the actions of the defendants, having satisfied both claims. The decisions have not entered into force.
A similar decision was made by a court in Kyzylorda, collecting 2 million tenge from the dropper.
“The dropper noted that she agreed to an offer in Telegram about possible earnings, for which she opened a bank account, which received the money she transferred, at the direction of the scammers, to third parties. I received 5, 000 tenge for each transaction,” the court was informed.
